Germany Sets December 2026 EU Vote on Tesla FSD (Supervised)

Germany’s Federal Ministry for Transport (BMDV) says an EU-wide decision on recognizing Full Self-Driving (Supervised) is slated for December 2026, following a postponement from October 6.
The update surfaced after @TeslaDE195932 shared a reply from the BMDV’s citizen service on X. The ministry added that the Technical Committee – Motor Vehicles (TCMV) will hold further consultations on October 6 ahead of the December vote and outlined elements of its ongoing review.
Technology-Open, But Skeptical on Speeding
According to the ministry, Germany is maintaining a “technology-open and safety-oriented” approach. The Federal Motor Transport Authority (KBA) is in direct discussions with Dutch vehicle authority RDW and Tesla to analyze all technical data before finalizing its voting position. RDW was responsible for giving FSD entry into Europe earlier this spring.
Officials noted that FSD (Supervised) appears capable of handling a broad range of traffic scenarios, particularly in complex city driving. However, several safety concerns remain:
- System Speeding: Regulators are concerned that FSD can automatically exceed posted speed limits by up to 50% in certain conditions.
- Urban Operation: The ministry is assessing whether driver-assistance features of this caliber should be permitted on dense inner-city streets.
- Driver Liability: Responsibility remains entirely with the driver, as FSD is classified as an SAE Level 2 system. In the event of a malfunction or incident, liability rests with the driver rather than the manufacturer.
Where Europe Stands Ahead of December
Germany’s overspeeding worry is linked to FSD’s Speed Offset feature. Similar reservations have been expressed by Sweden, France, and Croatia, as well as the European Transport Safety Council (ETSC). Croatia has nonetheless approved FSD for public-road use, while Sweden is urging the EU to withhold bloc-wide approval until the system strictly adheres to posted limits.
Several countries have not waited for a Brussels-led decision. Eight European nations have already granted independent national approval for FSD:
- Netherlands
- Belgium
- Denmark
- Lithuania
- Estonia
- Slovenia
- Czechia
- Croatia
Meanwhile, Tesla is in talks for FSD approval in Ireland and is nearing a green light in Italy.
It remains unclear whether Germany will issue its own national permit before the EU vote. With the KBA reviewing real-world driving data alongside the Dutch approval framework, Germany’s ongoing engagement leaves the path open for a broader rollout.
